ABSTRACT In the course of her defence of German protesters against Peter Singer's lectures, Jenny Teichman claims that the right to make use of a public platform is not covered by the principle of freedom of expression. I argue that this view is mistaken, and that she is also wrong to focus on whether Singer deserved a public platform. Instead I suggest that what matters is whether there was an attempt to prevent communication between a speaker and willing hearers. But (...) I agree with Teichman that there are some relevant differences between speaking from a public platform and speaking privately. In particular I argue that protesters have a right, though not one based on freedom of expression, to interrupt a public speaker. Such a right is on a par with the speaker's freedom to draw public attention to the fact that she has opinions which she thinks worthy of a hearing, and in exercising it a protester must not prevent those who wish to hear the speech from doing so. Finally I offer an argument against the view that disrupting Singer's lectures could be seen as a justified interference with freedom of expression. (shrink)

To understand the radical potential of Heidegger’s model of practice, we need to acknowledge the role that temporality plays within it. Commentaries on Heidegger’s account of practical engagement, however, often leave the connection between purposiveness and temporality unexplored, a tendency that persists in the contemporary discourse generated by the interaction between the phenomenological tradition and certain approaches within cognitive science. Taking up a temporality-oriented reading that redresses this can, I want to argue here, reveal new illuminating sites for the intersection (...) between phenomenology and the cognitive sciences, particularly between Heideggerian perspectives and what have become known as enactive approaches to the study of cognition. According to the latter, cognition is an inherently relational process through which the interaction of a living being and its environment generates meaning and, ultimately, a world of significance defined by the cogniser’s self-concern. I will suggest that this emphasis upon the inextricable intertwining of agent and world renders enactive models of cognition particularly congenial to a mutually enriching dialogue with Heidegger’s account of purposiveness, particularly if we read the latter in terms of the temporal framework that Being and Time offers us. Women have historically been prevented from living autonomously by systematic injustice, subordination, and oppression. The lingering effects of these practices have prompted many feminists to view autonomy with suspicion. Here, Marilyn Friedman defends the ideal of feminist autonomy. In her eyes, behavior is autonomous if it accords with the wants, cares, values, or commitments that the actor has reaffirmed and is able to sustain in the face of opposition. By her account, autonomy is socially grounded yet also individualizing and (...) sometimes socially disruptive, qualities that can be ultimately advantageous for women. Friedman applies the concept of autonomy to domains of special interest to women. She defends the importance of autonomy in romantic love, considers how social institutions should respond to women who choose to remain in abusive relationships, and argues that liberal societies should tolerate minority cultural practices that violate women's rights so long as the women in question have chosen autonomously to live according to those practices. Several technological developments, such as self-service technologies and artificial intelligence, are disrupting the retailing industry by changing consumption and purchase habits and the overall retail experience. Although AI represents extraordinary opportunities for businesses, companies must avoid the dangers and risks associated with the adoption of such systems. Integrating perspectives from emerging research on AI, morality of machines, and norm activation, we examine how individuals morally behave toward AI agents and self-service machines. Across three studies, we demonstrate that consumers’ moral concerns (...) and behaviors differ when interacting with technologies versus humans. We show that moral intention is less likely to emerge for AI checkout and self-checkout machines compared with human checkout. In addition, moral intention decreases as people consider the machine less humanlike. We further document that the decline in morality is caused by less guilt displayed toward new technologies. The non-human nature of the interaction evokes a decreased feeling of guilt and ultimately reduces moral behavior. These findings offer insights into how technological developments influence consumer behaviors and provide guidance for businesses and retailers in understanding moral intentions related to the different types of interactions in a shopping environment. This paper explores the implications of conceptualising phenomenology as explanatory for the ongoing dialogue between the phenomenological tradition and cognitive science, especially enactive approaches to cognition. The first half of the paper offers three interlinked arguments: Firstly, that differentiating between phenomenology and the natural sciences by designating one as descriptive and the other as explanatory undermines opportunities for the kind of productive friction that is required for genuine ‘mutual enlightenment’. Secondly, that conceiving of phenomenology as descriptive rather than explanatory risks (...) committing us to what Zahavi (2019) identifies as the error of equating the phenomenological with the phenomenal. Finally, that the erroneous reduction to the descriptive occludes the rich resources that the phenomenological tradition can contribute to investigations of non-human cognition. The second half of the paper then turns to focus specifically on the promising relationship between phenomenology and enactive approaches to cognition. It will suggest that phenomenology must be seen as having explanatory capacities if it is to shed light on the structures of “mind in life” (Thompson, 2007), before drawing on the model of explanation put forward by Louis Sass to explore what this might look like. There are many ways that accountants and managers can influence the reported accounting results of their organizational units. When such influence is directed at changing the amount of reported earnings, it is known as earnings management. The purpose of this paper is to present the results of surveys of undergraduate students, MBA students, and practicing accountants concerning their attitudes on the ethical acceptability of earnings management. Analysis of the survey results reveals how the attitudes of the three groups differ and (...) what variables are associated with these differences. Based on the analysis, the authors suggest changes in accounting education curriculum and ethics awareness programs in business which might increase students'' and practitioners'' sensitivity to the ethical ramifications of earnings management. Kierkegaard is considered by many to be the father of existentialism because he is believed to have asserted that our interpretations of existence are the expression of absolutely free choices, or choices for which no rational criteria can be given. This paper argues that that view is false. It presents a sketch of Kierkegaard position on the nature of human rationality, and argues that according to Kierkegaard, there are rational criteria for choosing between competing interpretations of existence and that people (...) make such choices only with reference to these criteria. In this paper, the theory of syllogistic reasoning proposed by Johnson-Laird is shown to be inadequate and an alternative theory is put forward. Protocols of people attempting to solve syllogistic problems and explaining to another person how they reached their conclusions were obtained. Two main groups of subjects were identified. One group represented the relationship between classes in a spatial manner that was supplemented by a verbal representation. The other group used a primarily verbal representation. Large Language Models (LLMs) could be a useful tool for lawyers. However, empirical research on their effectiveness in conducting legal tasks is scant. We study securities cases involving cryptocurrencies as one of numerous contexts where AI could support the legal process, studying GPT-3.5’s legal reasoning and ChatGPT’s legal drafting capabilities. We examine whether a) GPT-3.5 can accurately determine which laws are potentially being violated from a fact pattern, and b) whether there is a difference in juror decision-making based on complaints (...) written by a lawyer compared to ChatGPT. We feed fact patterns from real-life cases to GPT-3.5 and evaluate its ability to determine correct potential violations from the scenario and exclude spurious violations. Second, we had mock jurors assess complaints written by ChatGPT and lawyers. GPT-3.5’s legal reasoning skills proved weak, though we expect improvement in future models, particularly given the violations it suggested tended to be correct (it merely missed additional, correct violations). ChatGPT performed better at legal drafting, and jurors’ decisions were not statistically significantly associated with the author of the document upon which they based their decisions. Because GPT-3.5 cannot satisfactorily conduct legal reasoning tasks, it would be unlikely to be able to help lawyers in a meaningful way at this stage. However, ChatGPT’s drafting skills (though, perhaps, still inferior to lawyers) could assist lawyers in providing legal services. Our research is the first to systematically study an LLM’s legal drafting and reasoning capabilities in litigation, as well as in securities law and cryptocurrency-related misconduct. (shrink)

Some theodicists, skeptical theists, and friendly atheists agree that God-justifying reasons for permitting evils would have to have an instrumental structure: that is, the evils would have to be necessary to secure a great enough good or necessary to prevent some equally bad or worse evil. D.Z. Phillips contends that instrumental reasons could never justify anyone for causing or permitting horrendous evils and concludes that the God of Restricted Standard Theism does not exist—indeed, is a conceptual mistake. After considering Phillips’ (...) and other objections in the neighborhood, I argue that the Expanded Theism of Christian theology does forward a God who ‘digs in’ and eternally answers for horrors. The philosophy of “presence” seeks to challenge current understandings of meaning and understanding. One can trace its origins back to Vico, Dilthey, and Heidegger, though its more immediate exponents include Jean-Luc Nancy, Hans Ulrich Gumbrecht, and such contemporary philosophers of history as Frank Ankersmit and Eelco Runia. The theoretical paradigm of presence conveys how the past is literally with us in the present in significant and material ways: Things we cannot touch nonetheless touch us. This makes presence a post-linguistic or (...) post-discursive theory that challenges current understandings of “meaning” and “interpretation.” Presence provides an overview of the concept and surveys both its weaknesses and its possible uses. In this book, Ethan Kleinberg and Ranjan Ghosh bring together an interdisciplinary group of contributors to explore the possibilities and limitations of presence from a variety of perspectives—history, sociology, literature, cultural theory, media studies, photography, memory, and political theory. The book features critical engagements with the presence paradigm within intellectual history, literary criticism, and the philosophy of history. This chapter focuses on John Rawls's recent approach to liberal political legitimacy. His views on reasonableness and rationality are considered. It is argued that Rawls's legitimation pool for political liberalism is defined precisely in such a way as to exclude those whose prior commitments would lead them to reject political liberalism. Africanisation refers to a renewed focus on Africa, a reclaiming of what has been taken from Africa, and forms part of a post-colonialist and an anti-racist discourse. Africanising the curriculum involves developing scholarship and research established in African intellectual traditions. The idea is that this education will produce people who are not alienated from their communities and are sensitive to the challenges facing Africa. However, the idea of Africanisation is highly contested and may evoke a false or at least a (...) superficial sense of 'belonging,' further marginalisation, or it may emphasise relevance. This article discusses the possibility of Africanisation and takes further the argument of Graham Duncan of how Africans can reclaim their voices in the space of theological education. It unpacks the idea of Africanisation within higher education in general, examining the rationale behind the calls for Africanisation, followed by a discussion on the implications of Africanisation for theological education. This book reconstructs Heidegger’s philosophy of time by reading his work with and against a series of key interlocutors that he nominates as being central to his own critical history of time. In doing so, it explains what makes time of such significance for Heidegger and argues that Heidegger can contribute to contemporary debates in the philosophy of time. Time is a central concern for Heidegger, yet his thinking on the subject is fragmented, making it difficult to grasp its depth, (...) complexity, and promise. Heidegger traces out a history that focuses on the conceptualisations of time put forward by Aristotle, Plotinus, Augustine, Kant, Hegel, Bergson, and Husserl—an “alternative history of time” that challenges how time has been defined and studied within both philosophy and the sciences. In his path-breaking study, A Colonial Liberalism: The Lost World of Three Victorian Visionaries (1991), Stuart Macintyre makes a case for the distinctiveness of colonial liberalism and its local habitat, with liberals' insistence on the principle of political equality and the democratic right of self-government. Macintyre's three visionaries — Higinbotham, Pearson and Syme — were also leading crusaders against Chinese immigration, which peaked in Victoria in the 1850s, the decade in which self-government and manhood suffrage were introduced. The local habitat (...) wore a racial aspect. In this essay I suggest that it was precisely the democratic ideal of equality, espoused in the context of Chinese immigration and colonial nation-building, that led to the insistence on racial exclusion. Colonial liberals called for racial exclusion because of, not in spite of, their commitment to democracy. The apparent paradox of a policy of exclusion promoted in the name of equality was, I suggest, definitive of the project of colonial liberalism. (shrink)
